Please read these terms carefully before using IQ Smart Agents services. By accessing our website or purchasing a plan, you agree to be bound by these terms.
Section 1 — Acceptance of Terms
By using the IQ Smart Agents website or purchasing any service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our services. These terms apply to all visitors, clients, and anyone who accesses or uses our services.
Section 2 — Description of Services
IQ Smart Agents provides AI-powered voice receptionist services. Services include 24/7 AI call answering, appointment booking, SMS follow-up, and related integrations as described on our pricing page. Service features vary by plan (Entry, Mid Tier, Top Tier). We reserve the right to modify, update, or discontinue features with reasonable notice.
Section 3 — Payment and Billing
Monthly plans are billed on the same date each month. Yearly plans are billed annually. A one-time $199 setup fee applies to all monthly plans. The setup fee is waived for all yearly plan subscribers. Prices are subject to change with 30 days written notice. You are responsible for keeping your payment information current. Failed payments may result in service suspension.
Section 4 — Cancellation and Refunds
Monthly plans: You may cancel at any time. Cancellation takes effect at the end of your current billing cycle. No refunds are issued for partial months. Yearly plans: You may cancel within 14 days of your annual billing date for a full refund minus the setup fee (if applicable). After 14 days, yearly plans are non-refundable. Setup fee: The $199 setup fee is non-refundable once onboarding has begun.
Section 5 — Included Minutes and Overage
Each plan includes a monthly allocation of voice minutes (150, 450, or 850 depending on your plan). Minutes reset on your billing date each month and do not roll over. Usage beyond your included minutes is billed at your plan's per-minute overage rate ($0.35, $0.29, or $0.20 per minute). Overage charges are billed at the end of each billing cycle.
Section 6 — Acceptable Use
You agree not to use IQ Smart Agents services for any unlawful purpose, to harass or deceive callers, to violate any applicable telemarketing or communications laws, or to misrepresent your business or services. We reserve the right to suspend or terminate accounts that violate these terms.
Section 7 — Limitation of Liability
IQ Smart Agents provides services on an "as is" basis. We do not guarantee uninterrupted service or that the AI will handle every call perfectly. To the maximum extent permitted by law, IQ Smart Agents shall not be liable for any indirect, incidental, or consequential damages arising from use of our services. Our total liability for any claim shall not exceed the amount you paid us in the 30 days prior to the claim.
Section 8 — Intellectual Property
All content, branding, software, and materials on the IQ Smart Agents website are owned by or licensed to IQ Smart Agents. You may not reproduce, distribute, or create derivative works without our written permission.
Section 9 — Changes to Terms
We may update these terms at any time. We'll notify active clients of material changes by email. Continued use of our services after changes constitutes acceptance of the updated terms.
Section 10 — Governing Law
These terms are governed by the laws of the state of Nevada. Any disputes shall be resolved in the courts of Las Vegas, Nevada.
